My guess is that, because mer-people can ONLY live in the water (more or less), the reasoning is that it’d be unfair to let the humans have use of the land AND the sea; if one of them can only live in one area, then they BOTH should – or something like that.
Granted, if they could actively trade, or something, then they could EACH have a part of the land AND the sea, in a sense…
